1. About these terms
Tincakes ERP is provided by Dynamissimo cc, trading as Dynamic Computer Services ("DCS", "we", "us"), in partnership with TinCakes. These terms are an agreement between DCS and the business that subscribes ("you"). By ticking "I agree" and subscribing, or by using the app, you accept these terms and our Privacy Policy. If you don't agree, please don't subscribe or use the app.
2. What Tincakes ERP does
Tincakes ERP is a web app for TinCakes resellers to manage flavours and stock, clients, orders, back orders and payments, and to see sales summaries. It works on phones, tablets and computers. We may improve or change features over time (see section 9).
3. Who can subscribe
- You must be 18 or older and able to enter into a binding agreement.
- The app is for running a business, not for personal or household use.
- The details you give us must be accurate, and you must keep them up to date.
- If you subscribe on behalf of a business, you confirm you're allowed to bind that business to these terms.
4. Your account and team members
- The app is charged per user. Each person who uses your business account (for example, a partner) needs their own subscription, and a subscription gives access to that person only.
- You're responsible for everything done under your account, including by team members you invite. Make sure they follow these terms.
- Keep sign-in details private. Tell us straight away if you think someone has used your account without permission.
5. Subscription, price and payment
- The subscription is billed monthly in advance and renews automatically each month until you cancel.
- The price is R150 per user per month, excluding VAT (R172.50 including VAT). Each person pays for their own subscription at checkout. Cancelling one person's subscription doesn't affect anyone else's.
- Payments are processed by Paystack. We don't see or store your full card details.
- If a payment fails, we may pause that person's access to the app until the payment goes through. Your data is kept while access is paused (see section 7).
- We may change the price. We'll give you at least 30 days' notice by email or in the app before a new price applies to you, and you can cancel before it does.
6. Cancelling and refunds
- You can cancel at any time, without a penalty, in Account → Cancel my subscription or by contacting us.
- When you cancel, no further payments are taken. You keep access until the end of the month you've already paid for.
- We don't refund part-months or unused time, except where the law requires it or where we've made a billing mistake (for example, charging you twice), which we'll refund in full.
- Cooling-off: if the Electronic Communications and Transactions Act gives you a 7-day cooling-off right, you may cancel within 7 days of first subscribing and get a full refund within 30 days. By subscribing, you ask us to start the service straight away; where the law says that ends the cooling-off right, it no longer applies.
7. Your data and your clients' data
- Your business data is yours. This includes your flavours, stock, orders and client records. You give us permission to store and process it only to run the app for you, back it up and support you.
- You're responsible for your clients' personal information (for example, names and phone numbers you capture). Under the Protection of Personal Information Act (POPIA) you are the "responsible party" for it and we act as your "operator". You must have a lawful reason to collect it and tell your clients how you use it. Section 3 of our Privacy Policy sets out what we do as your operator.
- You can ask us for a copy of your business data at any time while subscribed, and for 90 days after your subscription ends. After that we delete it, unless the law requires us to keep it.
8. Using the app properly
You must not:
- use the app for anything unlawful, or to store information you're not allowed to have;
- try to get around its security or limits, or access other businesses' data;
- overload, attack, copy, resell or reverse-engineer the app;
- send spam or unlawful marketing to your clients using details stored in the app.
9. Availability, support and changes
- We work to keep the app available and accurate, but we can't promise it will always be available or error-free. Planned maintenance and problems with our hosting or payment providers can cause interruptions.
- Need help? Send a support ticket from the Help page (it opens an email to support@dyncomp.co.za), or call us on 011 740 2662 during office hours: Monday to Friday, 08:00–17:00, excluding public holidays. We aim to respond to tickets within 2 working days.
- Ideas for the app are welcome too: use "Send a feature request" on the Help page (software@dyncomp.co.za). We read every request but can't promise to build them.
- We may add, change or remove features. If a change takes away something important you rely on, we'll tell you first and you can cancel.
10. Keep your own records
The app helps you track sales, stock, payments and back orders, but it is not accounting, tax or legal advice. Check important figures yourself. You remain responsible for your own bookkeeping, tax returns and compliance.
11. Ownership
The app, including its software, design and wording, belongs to DCS or its licensors. You get a non-exclusive, non-transferable right to use it for your business while your subscription is active. "TinCakes" and "Cake in a Can" are TinCakes' trademarks and are used with permission.
12. Our liability — please read carefully
- To the extent the law allows, our total liability to you for any claim is limited to the subscription fees you paid us in the 3 months before the claim arose.
- We are not liable for indirect or consequential loss, or for loss of profit, sales, data or goodwill, including loss caused by downtime, wrong figures you rely on, or problems with third-party services such as hosting or payments.
- You agree to cover our reasonable costs and losses if a claim is made against us because you broke these terms or the law (for example, by storing your clients' details without a lawful reason).
- Nothing in these terms removes any right you have under the Consumer Protection Act or other law that cannot lawfully be excluded, or limits liability for our gross negligence or wilful misconduct.
13. Suspending or ending your access
We may suspend or end your access if you don't pay, break these terms, or use the app in a way that puts other users or our service at risk. Where possible, we'll warn you first and give you a chance to fix the problem. Sections 7, 11, 12 and 15 continue after your subscription ends.
14. Changes to these terms
We may update these terms. For important changes we'll give you at least 30 days' notice by email or in the app, and ask you to agree again. If you don't agree, you can cancel before the change applies. The version and date are shown at the top.
15. Disputes and law
If something goes wrong, contact us first and we'll try to resolve it within 15 working days. These terms are governed by the laws of the Republic of South Africa. Consumers keep any right to approach the National Consumer Commission or another body the law allows.
